Deliver value.JOB TITLE: SENIOR ENGINEER – SUBCONTRACTS (WELLS)This job is based in Sharjah.KEY RESPONSIBILITIES:Develop and manage commercial and subcontracts plan/strategy for various projects, carry out competitive bidding/ tendering activity in accordance with Company policies and procedures and projects requirements ensuring that is it delivered on timely basis.Plan and manage subcontract tender processes from issue through clarification, commercial and contractual evaluation, negotiation and recommendation for award, while coordinating the required technical evaluation and maintaining appropriate governance and recordsReview, draft and negotiate subcontracts, purchase orders and site services terms to protect the Company’s commercial position.Analyse client contract obligations and prepare appropriate flow-down requirements, special conditions and risk allocation for vendors and subcontractors.Draft and finalise qualifications, deviations, amendments and negotiation positions, and resolve material vendor and subcontractor departures.Coordinate inputs from Legal, Compliance, Tax, Insurance, Finance, Procurement, technical, HSE, Quality and project stakeholders.Carry out Vendor Pre-qualification process, Issue subcontract ITT package to approved tenderers, manage the clarification process (including close out of contractual and commercial qualifications) expedite responses, prepare formal commercial evaluation of bids and recommendation to award.Prepare and issue to the selected contractors approved Contracts/POs/LOIs and contract amendments.Maintain master subcontracts register and log all subcontract change authorisations and amendments.Where appropriate, liaise with Group Contracts for legal, tax, insurance and compliance teams to obtain their input into subcontracts.Work with the Business Services lines to negotiate subcontract terms with suppliers in line with Petrofac Best Practice and prepare justification for any significant exceptions for senior management approval.Ensure any agreed subcontract position is approved in line with the Delegation of Authority Matrix.Ensure that where appropriate the sub-contract terms are drafted to ensure full back-to-back coverage.Prepare subcontract approval paperwork (subcontract RRC, GRRC and Tender Board paperwork) in support of ITT’s and awards.Gain full understanding of company procedures and processes and follow these principles in all aspects of the role.Support Project Managers in presenting the Company’s position to suppliers and advise managers on their subcontract rights and obligations.Development of standard ITT and subcontract templates for differing categories of activities.Lead in the resolution of subcontract claims and disputes.Manage post contract activities – Variations, call off Orders, Claims, Change Orders, Stage wise Invoicing review, Work completion notes, Performance Bonds, Warranties monitoring, KPIs, Insurances, Contract close out. Expediting and Logistics support for material procurement as required.Support documentation for Duty exemptions, Free Zone material movement, Shipments, B/L, COC, COO and relevant documents related to material procurement.Draft and review ancillary agreements, including NDAs, MOUs, LOIs, novations, variations and amendments.Actively provide input to Inhouse Turus system through various functions i.e. action, lessons, risks etc.ESSENTIAL QUALIFICATIONS AND SKILLS:Degree or equivalent experience in Law, Commerce, Quantity Surveying, Engineering, Supply Chain, Business or a related discipline.Significant experience in subcontracts, procurement, contracts or commercial management within energy, oil and gas, engineering, construction or industrial services.Demonstrated ability to interpret prime contract requirements, develop flow-down provisions and negotiate complex subcontract terms.Knowledge and experience of head and subcontract terms related to wells, drilling, well management, platform operations and maintenance, OPEX and CAPEX engineering & construction, logistics, etc. (FIDIC, LOGIC contracts, INCO terms.)Broad understanding of Well Construction activities including Drilling, Completions, Well Testing, and Well Services activitiesPrior experience of similar role in wells organisationMENA experience is desirable. Engineers with strong site-based commercial or subcontracting experience are encouraged to apply.Strong drafting, negotiation, analytical, commercial judgement and stakeholder management skills.
